These Terms of Service (“Terms”) govern your use of the CoinValue website and service at coinvalue.com (the “Service”) operated by CoinValue (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

CoinValue provides coin identification, condition assessment, error/variety detection, and market valuation estimates based on photographic analysis. The Service includes free and paid tiers, a personal coin collection dashboard, and related features.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's consent.

3. Account and Registration

• You may use limited features without an account. To unlock full valuations, you must provide a valid email address.
• You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
• You agree to provide accurate, current, and complete information.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free and Paid Services

Free Tier

• You receive 3 free coin scans. Coin identification is provided for free; market valuations require email registration.
• Failed scans (API errors or non-coin images) do not count toward your free scan limit.

Paid Subscriptions

• Paid memberships provide unlimited scans, collection management, and additional features as described on our pricing page.
• Subscription fees are billed in advance on a monthly or annual basis through Stripe.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.
• We reserve the right to change subscription prices with 30 days' notice. Price changes do not apply retroactively to existing billing periods.

One-Time Purchases

• One-time report purchases provide a fixed number of scan credits that do not expire.
• One-time purchases are non-refundable except as required by applicable law.

5. Valuation Disclaimers

IMPORTANT: CoinValue provides estimates only. Our valuations are generated using automated technology and are intended for informational and educational purposes only. They are not professional appraisals, certifications, or guarantees of value.

• Actual coin values may differ significantly from our estimates based on market conditions, coin authenticity, and factors not visible in photographs.
• Our condition assessments are estimates and should not be relied upon as professional grading.
• Error and variety detection is provided as a convenience and may not identify all errors or may occasionally flag non-errors.
• We are not responsible for financial decisions made based on our valuations.
• For coins of significant value, we strongly recommend obtaining a professional assessment from a qualified numismatist or grading service.

6. User Content

• You retain ownership of all coin images you upload to the Service.
• By uploading images, you grant us a limited, non-exclusive license to process, analyze, store, and display those images as necessary to provide the Service.
• You represent that you have the right to upload any images you submit and that they do not infringe on any third party's rights.
• We may use anonymized, aggregated data derived from user activity to improve the Service, but we will not share your individual coin images with third parties for their own purposes.

7. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law.
• Attempt to circumvent scan limits, rate limits, or access controls.
• Use automated tools (bots, scrapers) to access the Service without our written permission.
• Upload images containing malicious code, malware, or content unrelated to coins.
• Interfere with or disrupt the Service or its infrastructure.
• Impersonate another person or entity.
• Use the Service to facilitate counterfeiting or fraud.
• Resell or redistribute our valuations or reports without our written permission.

8. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by CoinValue and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

9. Third-Party Services

The Service integrates with third-party providers including Google (for image analysis), Stripe (for payments), and eBay (for market reference links). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COINVALUE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OR INABILITY TO USE THE SERVICE;
• ANY INACCURACY IN COIN IDENTIFICATION, GRADING, OR VALUATION;
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;
• ANY THIRD-PARTY CONDUCT ON THE SERVICE;
• ANY OTHER MATTER RELATING TO THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless CoinValue and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the state where the user resides. Each party waives the right to a jury trial and to participate in a class action.

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

14. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
